Terms and Conditions for CryAGN Notary Services
Introduction
These Terms and Conditions govern the use of notary services provided by CryAGN Notary Services, an Orlando, Florida-based notary business. By engaging our services, you agree to be bound by these terms and conditions.
### Services Offered
CryAGN Notary Services offers the following notary services:
- 1. Witnessing and attesting signatures on documents
- 2. Administering oaths and affirmations
- 3. Certifying copies of original documents
- 4. Verifying the identity of individuals signing documents
### Client Responsibilities
- 1. Provide accurate and truthful information to the notary public.
- 2. Present valid, government-issued photo identification.
- 3. Ensure that the documents being notarized are legal and do not involve any fraudulent or unlawful activities.
- 4. Pay the applicable fees for the notary services rendered.
### Notary Responsibilities
- 1. Verify the identity of the client through valid, government-issued photo identification.
- 2. Ensure that the client is acting of their own free will and is competent to understand the nature of the transaction.
- 3. Maintain a detailed record of all notarial acts performed.
- 4. Adhere to the highest standards of professional conduct and comply with all applicable laws and regulations.
### Fees and Payment
1. Our notary fees are as follows:
- Standard Notarization: $10 per signature
- Verifying a VIN - $25.00
- E-notarizations - $25.00
- Travel Fees: $0.67 - $1.00 per mile (with a minimum travel fee of $10 outside of a 2 mile radius of base office)
- After-Hours Fee: (10 PM - 8 AM) Additional 15-$25 for services provided outside regular business hours.
- Holiday Charges - $25
2. Payment is due at the time of service delivery unless alternative documented arrangements have been made in advance with CryAGN Notary Services.
3. Accepted payment methods include cash, credit/debit cards, and electronic transfers.
### Appointment Scheduling
To access our services, you can book an appointment on our website or reach out to us via phone or email. We will strive to meet your preferred date and time, but reserve the right to reschedule appointments when needed.
### Cancellation Policy
CryAGN Notary Services understands that unforeseen circumstances may arise requiring the cancellation or rescheduling of appointments. In order to provide efficient and reliable service, we have established the following cancellation policy:
- 1. Clients are required to provide a minimum notice of one (1) hour for cancellations or rescheduling requests. Failure to notify us within this time frame may result in a cancellation fee.
- 2. If a client needs to cancel or reschedule an appointment, they must contact CryAGN Notary Services directly via phone or email and provide their name, appointment date and time, as well as the reason for cancellation/rescheduling.
- 3. Cancellation fees will be applied as follows:
a) For cancellations made less than one (1) hours before the scheduled appointment time, a fee equivalent to 50% of the total service cost will be charged.
b) For no-shows or failure to cancel an appointment without prior notice, clients will be charged 100% of the total service cost.
- 4. CryAGN Notary Services reserves the right to waive any cancellation fees at their discretion in cases where genuine emergencies arise.
- 5. In situations where our notary public is unable to fulfill an appointment due to unforeseen circumstances (e.g., illness, family emergency), clients will be notified as soon as possible and every effort will be made by CryAGN Notary Services to reschedule at a mutually convenient time without any additional charges.
- 6. We understand that certain circumstances may require flexibility in enforcing this policy; therefore, exceptions can be made on a case-by-case basis at our sole discretion.
- 7. This cancellation policy is subject to change without prior notice; however, any changes made will not affect appointments already scheduled unless explicitly communicated by CryAGN Notary Services.
By utilizing our services and confirming an appointment with CryAGN Notary Services, clients acknowledge their understanding and acceptance of this cancellation policy clause outlined above in its entirety.
### Liability and Limitations
1. CryAGN Notary Services shall not be held liable for any errors, omissions, or misrepresentations made by the client.
2. The notary public's role is limited to witnessing and attesting signatures, administering oaths, and verifying identities. The notary does not provide legal advice or interpret the contents of the documents being notarized.
3. CryAGN Notary Services reserves the right to refuse service if the requested notarial act is deemed unlawful, unethical, or contrary to the notary's professional judgment.
### Indemnification
You agree to indemnify, defend and hold harmless CryAGN Notary Services, its officers, directors, employees, agents, affiliates, successors and permitted assigns (collectively, "CryAGN") from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising out of or resulting from:
- Your use or misuse of the notary services provided by CryAGN;
- Your breach of these Terms and Conditions; or
- Your violation of any third-party right, including without limitation any copyright, trademark, trade secret, or other property right or privacy right.
You further agree that CryAGN assumes no responsibility for any document certified through its notary services, including but not limited to the accuracy, validity or legal effect of the contents therein. CryAGN's role is solely to witness and certify the signature(s) on the document(s) presented to its notaries.This indemnification obligation will survive the termination of your relationship with CryAGN and these Terms and Conditions.
### Confidentiality
CryAGN Notary Services understands the importance of protecting the confidential information of our clients. We are committed to maintaining the highest standards of confidentiality and privacy in accordance with applicable laws and regulations.
- Definition of Confidential Information
Confidential Information includes, but is not limited to, personal information, financial data, business plans, trade secrets, and any other non-public information related to our clients or their transactions.
- Non-Disclosure
CryAGN Notary Services and its employees, contractors, and agents shall not disclose, share, or distribute any Confidential Information to any third party without the prior written consent of the client, except as required by law or court order.
- Safeguarding Confidential Information
We shall implement and maintain appropriate technical, physical, and administrative safeguards to protect the confidentiality, integrity, and security of Confidential Information. These safeguards may include, but are not limited to, encryption, access controls, and secure storage and transmission protocols.
- Limitation of Use
CryAGN Notary Services shall use Confidential Information solely for the purpose of providing notary services to our clients and shall not use or exploit such information for any other purpose without the client's prior written consent.
- Compliance with Laws
We shall comply with all applicable laws and regulations regarding the protection of Confidential Information, including but not limited to the Florida Notary Public Law and the Florida Information Protection Act.
- Survival of Obligations
The obligations of confidentiality and non-disclosure set forth in this clause shall survive the termination or expiration of any agreement or engagement between CryAGN Notary Services and its clients.

### Governing Law
This Terms and Conditions document ("Agreement") is entered into by and between CryAGN Notary Services ("Company") and the users of its services ("User"), collectively referred to as "Parties".
- 1. Governing Law: This Agreement, and any claim, dispute, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof (collectively referred to as "Disputes"), shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of law provisions.
- 2. Venue: Any action arising from or related to this Agreement shall be brought exclusively in the state or federal courts located within Orange County, Florida. User hereby consents to personal jurisdiction in such courts for all legal proceedings that may arise out of or relate to this Agreement.
- 3. Arbitration: In case a Dispute arises between Company and User regarding matters covered by this Agreement that cannot be resolved through mutual discussion within 30 days from written notice thereof being given by one Party to another, both Parties agree that such Dispute shall be settled through binding arbitration held in Orlando County under the Commercial Arbitration Rules of the American Arbitration Association.
- 4. Class Action Waiver: To the fullest extent permitted by applicable law, User agrees that any arbitration proceeding will only address disputes on an individual basis and not on a class-wide or consolidated basis. User also agrees that any claim against Company must be filed within one year after it arose; otherwise it will be permanently barred.
- 5. Severability: If any provision(s) of this Governing Law clause are held invalid or unenforceable for any reason whatsoever, then such provision(s) will be deemed severable from these Terms and Conditions and shall not affect the validity or enforceability of any remaining provisions.
By using CryAGN Notary Services' website/platform/application/services (“Services”), User acknowledges having read, understood, accepted, and agreed to abide by all terms stated herein including those related to governing law.
### Entire Agreement
This Terms of Service, along with any documents expressly incorporated by reference, constitutes the entire agreement between you and CryAGN Notary Services regarding your use of our notary services.
This agreement supersedes any prior agreements or understandings, whether written or oral, regarding the same subject matter.
CryAGN Notary Services may modify these terms and conditions from time to time, and your continued use of our services after any such modifications constitutes your acceptance of the new terms and conditions.
No representation, inducement, promise, or agreement, oral or otherwise, between you and CryAGN Notary Services, not contained herein, shall be of any force or effect.
### Modifications
CryAGN Notary Services reserves the right to modify or update these Terms and Conditions at any time without prior notice. The most current version of the Terms and Conditions will be available on our website or upon request.
