Terms and Conditions – CryAGN Mobile Notary Services LLC
Introduction
These Terms and Conditions govern the use of notary services provided by CryAGN Mobile Notary Services LLC, an Orlando, Florida-based notary business. By engaging our services, you agree to be bound by these Terms and Conditions.
Services Offered
CryAGN Mobile Notary Services LLC, offers the following services:
- Witnessing and attesting signatures on documents
- Administering oaths and affirmations
- Certifying copies of original documents
- Verifying the identity of individuals signing documents
- Vehicle Identification Number (VIN) verifications
- Remote Online Notarization (RON) services
- Provision of independent witnesses (upon advance request and subject to availability)
Client Responsibilities
Clients agree to:
- Provide accurate and truthful information.
- Present valid, unexpired, government-issued photo identification at the time of service.
- Ensure all documents presented for notarization are lawful, complete, and do not involve fraud or misrepresentation.
- Supply required independent witnesses unless witness provision services were arranged with us in advance. Any client-provided witnesses must also present valid government-issued photo identification.
- Pay all applicable fees (including travel fees) at or prior to the time services are rendered unless alternative arrangements have been made in writing.
Notary Responsibilities
CryAGN Mobile Notary Services LLC will:
- Verify client identity using valid, government-issued photo identification.
- Confirm the client is acting willingly and is legally competent.
- Maintain a record of notarial acts as required by law.
- Follow all applicable Florida laws and uphold the highest standards of professional conduct.
Fees and Payment
Our fees are as follows:
- Standard Notarization: $10 per statutory seal/signature
- VIN Verification: $25
- E-Notarizations / Remote Online Notarization (RON): $25 (Platform Dependent)
- Travel Fees: $0.67–$1.00 per mile (minimum $10 fee beyond 5-mile radius)
- Witness Fee (If Provided by Us): $15–$25 per witness (advance notice required)
- After-Hours Fee (10 PM – 8 AM): Additional $15–$25
- Holiday Fee: Additional $25
Travel Fee Policy
- Travel fees cover time, mileage, and scheduling for mobile service. Travel fees are deemed fully earned upon our arrival at the designated location. In the event a notarization cannot be completed due to a client’s lack of valid ID, incomplete documents, refusal to sign, or statutory refusal under Florida law, the client remains responsible for 100% of the agreed travel fee.
Payment Terms
- Payment is due at the time of service unless previously agreed upon in writing. Accepted payment methods include cash, credit/debit cards, and electronic transfers.
Appointment Scheduling
Appointments can be booked via our website, phone, or email. We will strive to accommodate preferred times but reserve the right to reschedule when necessary.
Cancellation Policy
Cancellations must be made at least 1 hour prior to the scheduled appointment.
Contact us directly via phone or email with your name, appointment time, and reason for cancellation or rescheduling.
Cancellation Fees:
- Less than 1 hour notice: 50% of the total service cost
- No-shows or failure to cancel: 100% of the total service cost
CryAGN Mobile Notary Services may waive fees in genuine emergency situations, at our discretion.
If we must cancel due to unforeseen circumstances, we will notify you as soon as possible and reschedule without additional charges.
This policy is subject to change, but changes will not affect existing scheduled appointments without prior notice.
Reasons for Service Refusal
- In accordance with Florida Law (Fla. Stat. Ch. 117), the notary public reserves the right or is legally required to decline service if:
- Failure to Appear: The signer does not personally appear before the notary (in person or via an approved RON audio-video platform).
- Lack of Proper Identification: Any signer lacks valid, unexpired, government-issued photo identification meeting Florida statutory standards.
- Incapacitation: A signer appears confused, mentally incapacitated, disoriented, or unaware of what they are signing.
- Coercion: A signer appears to be acting under coercion, pressure, or duress.
- Incomplete Documents: The document presented is incomplete, contains blank fields, or is missing required pages.
- Illegal Activity: The notary knows or suspects the transaction is fraudulent, deceptive, or illegal.
- Conflict of Interest: There is a direct financial or familial conflict of interest as prohibited by Fla. Stat. § 117.107.
- Language Barrier: The signer and notary do not share a common direct language and an interpreter cannot legally bridge the gap for notarization.
Refusal of service under these conditions is a legal requirement and does not constitute a breach of contract.
Liability and Limitations
- CryAGN Mobile Notary Services is not liable for any misrepresentations or errors on the part of the client.
- Our role is strictly limited to notarization. We do not provide legal advice or interpret document content.
- We reserve the right to refuse service if the request is illegal, unethical, or violates notarial standards.
Indemnification
By using our services, you agree to indemnify and hold harmless CryAGN Mobile Notary Services LLC and its associates from any claims, losses, damages, or liabilities arising from:
- Your misuse of our services
- Your breach of these Terms
- Your violation of any third-party rights
- This includes but is not limited to legal costs and attorney fees. This clause survives termination of services.
Confidentiality
We take client confidentiality seriously.
- Definition: Confidential information includes personal data, financial info, business details, and any non-public information.
- HIPAA Compliance: We are fully HIPAA compliant-certified. Any Protected Health Information (PHI) encountered during the course of our notary services is handled, stored, and protected in strict accordance with the Health Insurance Portability and Accountability Act.
- Non-Disclosure: We will not disclose client information without written consent, unless required by law.
- Safeguards: We implement appropriate security measures, including encryption, access controls, and secure storage.
- Use Limitation: Information is used solely for delivering notary services.
- Compliance: We comply with all Florida and federal privacy laws.
- Survival: Confidentiality obligations continue beyond service completion.
Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Florida.
All legal actions shall be brought in courts located in Orange County, Florida.
Unresolved disputes shall be submitted to binding arbitration under the AAA Commercial Arbitration Rules in Orange County.
Class Action Waiver:
- All claims must be made individually — no class or consolidated actions are allowed.
- Any claim must be filed within one (1) year or it will be barred.
- If any provision of this section is found invalid, the remainder will still apply.
Entire Agreement
These Terms constitute the entire agreement between you and CryAGN Mobile Notary Services LLC. Any prior oral or written agreements are superseded.
Modifications
CryAGN Mobile Notary Services reserves the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms. The latest version will always be available on our website or upon request.
Acknowledgment
By using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
